Terms of Service

The agreement between you and Orty.

These terms are written in plain language on purpose. By buying or using Orty, you agree to them. If anything is unclear, email us before you buy.

1. The parties

"Orty," "we," and "us" refer to Orty, the indie software studio that makes Orty. "You" refers to the person who purchases and uses the software. Orty is solo-founded and operated.

2. License grant

Purchase of Orty grants you a single-user, non-transferable, non-exclusive license to install and run the software for your own personal or business use. "Single-user" means one person — you. You may install the software on more than one of your own machines (for example, a desktop and a laptop), but you may not share your copy with other people.

3. Permitted use

You may:

  • Install and run Orty on your own Windows machines.
  • Use the software to rate creators, draft cold emails, and manage your outreach CRM.
  • Make reasonable backups of your local CRM and app data for your own use.
  • Use your own Groq and Google Gemini API keys in accordance with those providers' own terms of service.

You are responsible for complying with all applicable laws in your use of the software, including email regulations such as CAN-SPAM, GDPR, and CASL. The app helps with CAN-SPAM by appending a compliance footer to generated emails, but compliance is ultimately your responsibility.

4. Prohibited use

You may not:

  • Redistribute, resell, sub-license, lease, or rent the software to anyone else.
  • Share your copy with other people. Each person who uses the software needs their own purchase.
  • Reverse engineer, decompile, or disassemble the software, except to the extent that applicable law explicitly prohibits this restriction.
  • Use the software to send unsolicited email in violation of applicable law, or to generate content that is unlawful, defamatory, or infringes the rights of others.
  • Remove, alter, or obscure any proprietary notices in the software.

5. Payment and delivery

Orty is sold as a one-time purchase of $29 USD (beta price). For the manual payment methods (PayPal, crypto), you send payment directly and email your transaction reference; Orty never sees your card or wallet credentials. Upon verification, you are emailed a download link to the Windows installer (OutreachRater-Setup.exe, approximately~96 MB). Delivery is electronic, usually within 24 hours. No account creation is required to use the app.

The beta price of $29 is the lowest the software will ever be sold for. The price will increase when Orty reaches a 1.0 release. Beta buyers retain their purchase price — including all future updates — at no additional cost.

6. Refund policy

Orty comes with a 7-day money-back guarantee. Refunds are issued if the installer fails to run or the core features do not work as described. Refunds will not be issued for AI-drafted content you are personally unsatisfied with, since output quality depends on your own API key usage and the information you provide about your business.

This policy is designed to be fair to both sides: you can get your money back if the software doesn't actually work, and we aren't left refunding a delivered, working product over a subjective dislike of AI output.

7. Disclaimer of warranty

The software is provided "as is" and "as available," without warranties of any kind, whether express or implied. Orty does not warrant that the software will be error-free, uninterrupted, or that it will meet your specific requirements.

Because the software relies on third-party AI providers (Groq and Google Gemini) that you access with your own keys, Orty cannot guarantee the availability, accuracy, or cost of those services. Any reliance on AI-generated content (ratings, email drafts, audits) is at your own risk — always review what the model produces before acting on it.

To the extent permitted by applicable law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.

8. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Orty be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the software — even if advised of the possibility of such damages.

Orty's total liability for any claim arising out of or relating to the software is limited to the amount you paid for the software (i.e., $29 USD). You are responsible for your own data; because Orty does not store your data, Orty cannot be liable for its loss. Back up your CRM.

9. Third-party services

Orty integrates with Groq and Google Gemini, which you access using your own API keys. Your use of those services is governed by their respective terms of service and privacy policies. Orty is not responsible for the behavior, availability, pricing, or data practices of those providers. The software also uses yt-dlp to download audio for the Long Form feature; yt-dlp is licensed under the Unlicense.

10. Governing jurisdiction

These terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms or the software will be resolved in the courts located in [JURISDICTION], and you consent to the personal jurisdiction of those courts.

Note: the [JURISDICTION] placeholder above will be replaced with the founder's actual jurisdiction before the product goes fully live. It is left as a placeholder intentionally until that detail is finalized.

11. Changes to these terms

We may update these terms from time to time. If we do, the "last updated" date above will change, and material changes will be communicated to buyers by email. Continued use of the software after a change constitutes acceptance of the updated terms.
